Reporting to the Head, Group Tax, you are responsible for covering all tax matters for the Asia South and Asia North regions, including direct and indirect tax compliance, transfer pricing, tax planning and advisory, tax controversy, customs, and projects. The position may also support international growth projects as directed by the UAE.
This role requires expertise in taxes and customs within Borouge’s locations and the ability to develop recommendations for the line manager. The position also assists with strategic and operational projects. With a strong grasp of corporate objectives, the role involves working closely with the line manager and stakeholders to implement plans that achieve project goals.
Key Accountabilities:
Strategic Tax and Customs Planning
Manage the Regionlal corporate legal entity structure to accommodate the complex operating business models, funding, value chain evaluation, mergers/acquisitions and disposition, the placement of international assignees from tax perspectives.
Assist in facilitating the negotiations with relevant authorities on all tax incentives matters including application for new incentives and renewal of existing incentives.
Ensure that intercompany transactions are transacted on an arm’s length basis that satisfy the Group’s global transfer pricing policy and guidelines and the local jurisdiction’s transfer pricing requirements.
Identify customs duty saving opportunities and lead the applications and negotiations with relevant customs authorities for customs rulings/exemptions/incentives to overall business cost.
Spearhead the documentation requirement, such as sales, vendor and intercompany agreements, board meeting and business operating procedures manual as needed to meet tax and custom regulatory purpose.
Identify key tax risk, address the risk with relevant stakeholders and provide mitigating steps to eliminate the risk.
Provide advice on dividend distribution and intergroup funding proposal for withholding tax consideration.
Develop solutions to mitigate potential permanent establishment risk that could arise during furtherance in our business.
Co drive tax related data integrity initiatives, including but not limited to good understanding of SAP systems to limit tax pain point exposure, automation of tax prescribed reports needed for return filing, deploying the use of appropriate tax related software for automation to increase productivity with regards manual preparation of tax related schedules and information needed by competent authorities.
Communication on changes in tax laws/rules/guidelines or where OECD discussion draft potentially affects the Group’s operating structure, including but not limited to BEPS.
Facilitate the development and endorsement of the content for proper execution of business model workshops and operation structures in a tax environment.
Projects
Assist with projects/initiatives to tax (direct, indirect) and customs governance, where they are broad-based and relate to the strategy and operational businesses of Borouge.
Develop project objectives and implementation plan, and assists in driving the execution of these projects, including coordination across various stakeholders, tracking and monitoring progress and project metrics, developing of presentation materials (as required), etc.
Collaborate with relevant stakeholders to provide strategic discussions materials on directions and/or approaches to resolve identified issues.
Assist to create and develop content for executive-level presentations and reports, provide in-depth research on the law to support the content for discussion.
Create and develop content for project workshops and working sessions.
Tax Controversy and Tax Dispute Resolution
Review and approve all submissions and information provided to all competent authorities to ensure that the information provided is aligned with the Group’s operating structure.
Coordinate tax discussions and settlement meetings with tax authorities.
Assist in evaluating the settlement outcome to propose an optimal recommendation to senior management and relevant internal stakeholders.
Assist to develop/implement post settlement action plans to remediate/mitigate future tax implications arising from the settlement outcome with the competent authorities.
Tax Compliance and Tax Accounting
Responsible for the timely review and filing of the required tax returns within the stipulated filing deadline.
Ensure that tax residency requirements are met for the entities in the covered region to enjoy tax treaty benefits and exemptions.
Adhere to financial close deadline and approve current and deferred tax expenses provision for account recording.
Approve ledger analysis from Accounting team to ensure the tax disclosure requirement are met for return preparation purposes.
Ensure transfer pricing documentations are in place and that CbC notification are prepared/filed on a timely basis.
Approve tax disclosure notes in the audited financial statements.
About You:
Bachelor’s Degree in Finance or an equivalent professional certification
At least 15 years of experience with a leading international tax consulting firm and in a lead tax role in a large MNC commercial setting
Working experience in the petrochemical industry is an advantage
Accredited Tax Practitioner/Advisor is an advantage
