The Talentmate.com Site, App or Services are ideally setup only to be used by people looking for employment opportunities and openings, as well as people interested in taking advantage of other career-enhancing services that the companies may offer (collectively, "Candidates"); and by people and/or organizations interested in posting information about open job positions, including but not limited to, recruiting agencies functioning for/on behalf of multiple employers or organizations to fill the available job vacancies with them (collectively, "Employers"). In areas addressing both groups, the Candidates and the Employers here collectively referred to as "Users".

The Platform's sole objective is to act as a preliminary means of communication and information sharing between Users who have a sincere desire to connect with one another and/or be contacted regarding actual job openings and other career-enhancing services.

Use of Website and Services

The Site, App or Services are intended to serve the Candidates and the Employers to find suitable job positions and potential applicants respectively. You agree to use Talentmate.com only for legally permitted purposes as per the stated context of acceptable use of the Site or Services.

You agree not to create, support, or make use of software, scripts, robots, devices, or other tools or ways for scraping content from Talentmate (including but not limited to web browsers, plugins, and crawlers), except as an internet search engine that makes the data searchable by users.

Additionally, you agree to display only limited portions of any page from Talentmate.com to your viewers with clear mentioning of the source as Talentmate, and with a link to that corresponding page which is easily directing to that particular page with a click without requiring users to register on your site, provide their email address, make payments, view additional pages, or take any other additional steps in between.

Talentmate authorizes the Users to view or download any material on the Site or App for your personal, noncommercial use only. Giving permission to use any of the Site material is no way interpreted as a sale or granting of any of the owner's rights. The Site, App, or Services may only be used for your personal use, any data included within, or any rights of you within this agreement may not be leased, rented, sublicensed, or transferred to any other person. You are not allowed to create or extract any Telentmate.com data for commercial selling in machine-readable or in any other form that integrates or utilises a significant portion of the Site or App. Without the prior written consent of the Talentmate, you are not permitted to transfer or store any data that is present on or exchanged through the Site or App to any electronic network for use of any other person than you. Any copies of the Site content that you produce must include all trademark, copyright, service mark, and other type of proprietary notices that were present in the original material. You may not copy, edit, reproduce, publish, display, transfer, distribute, perform, license or make derivative works from any Website content, unless expressly permitted by us. It's not permitted either to use the website content for any purpose on any other site or in any networked computer environment, nor to copy, modify or adapt any written HTML codes of the Talentmate pages.

You hereby represent, warrant, and agree that your use of the Website or App will comply with these Terms of Services, and will not use the Site for any purposes or in any manner that are prohibited under these Terms and Conditions or by any applicable laws.

User License for Candidates:

You are hereby granted by Talentmate a limited, non-exclusive, and terminable right to access and use the Site solely for your own personal job-seeking needs. It allows you to view, access and download a single copy of the Site's content for personal, non-commercial use. Talentmate, in its sole discretion, retains the right to suspend or terminate your permission to use the Site or Services at any time.

Use of Personal Information

You will be asked to provide some personal information regarding You with Us during the registration processes such as, including but not limited to, your name, valid email address, contact number, location, etc.

You agree and acknowledge that Talentmate may use your information gathered via registration processes or from your use of our Services to disclose it to third-parties (on an anonymous basis) without disclosing your personal identity. Except in the case if We may require disclosing the details as part of legal proceedings or by applicable laws, We will never share personally identifiable information such as name, address, contact number, etc., to any third-party without your prior consent.

We reserve the right to offer you, based on the choices you make during the registration processes or at any other time afterwards, third-party products and services.

License to Use User Content

By submitting your content to any publicly viewable or non-public areas of the Site or App, You grant Talentmate and its affiliates the royalty free, irrevocable, unrestricted, perpetual, assignable, sub-licensable, transferrable, worldwide, non-exclusive right (including moral rights) and license, in all formats or media or technology (whether now known or later devised, developed or discovered), to collect, store, use, copy, reproduce, adapt and adjust, translate, modify, publish, distribute, prepare and generate derivative works from, communicate to the public, perform and display your submitted information.

You further warrant that the owner of any rights (including, but not limited to, moral rights) in the submitted content has validly and irrevocably granted you the right to grant the aforementioned license. You also agree to permit subscribers to access, view, store, display and reproduce such content for personal use. The owner of any content posted on the Site maintains all rights that may exist in that content, subject to the aforesaid.

You agree to Talentmate's unrestricted use of any thoughts, know-how, ideas, or techniques You shared with Us for any objective. You further agree to indemnify, defend and hold Talentmate free from any claims of liability resulting from the use or dissemination of any such materials or information.

Eligibility

Talentmate has some eligibility measures in place which the Users must understand and promise to follow in order to enter into this contract and make use of the Website, APP and Services. By deciding to use the Platform, you agree and warrant that you understood and are eligible to enter this contract and use the Platform.

• Minimum Age: The minimum age requirement for anyone to use our Platform is 16 years of age. Anyone under the age of 16 is not meant to use our Website, App or Services.
• Profile Creation: Users should have only one account created on our Platform using accurate personal details such as their real names, email addresses, etc. Using false information to create your profile is a violation of our Terms of Service. You are not allowed to create an account and use it on behalf of someone else or those who are below the minimum age mentioned above. Furthermore, you are not allowed to create a new account and use the Platform in case you are already found violating our terms and hence restricted from using the Platform.

User Registration and Password

Registering Your Account/Creating Your Profile with Talentmate will enable you to have login credentials (Login Email ID/Phone Number, Password, etc.) to that personal account.

• You are responsible for keeping the account details such as login ID/number and password secure and confidential. You are also responsible for all the account uses and actions that take place under your registered login and password, no matter whether it is authorized by you or not.
• Your account and password will give you access to non-public areas of the Platform and hence it is strictly prohibited to share/disclose your account and password details with any third parties.
• You agree to inform Talentmate immediately when you have noticed of any inappropriate or unauthorized use of/activities or postings from your account and password.
• You agree that Talentmate will not be liable for any damages or loss that occurred to you from an authorized use of your registered account and password. However, the Platform will look for all the possible options from our side to make sure that there will be no compromise of login credentials of the registered user accounts.
• If the Platform detects or suspects any unauthorized or inappropriate use or activities from your registered account and password, We have the right to suspend or terminate your account and access to the Platform.

Payment, Cancellation and Refund Policy

You can use Talentmate.com for free as a basic user, but to get access to additional features without limitations on your use, you must purchase any of the subscription packages provided with varied features and access limits.

Subscription Payment:

• Payment for chosen packages should be made upfront to unlock the full features.
• Users are responsible to pay the amount of current package, payment for any additional features, and payment of renewal of such packages.
• Users are required to pay relevant taxes, if any.
• Cards Accepted for Payment: Mastercard, Visa, etc.

Auto Renewal:

• All subscription packages will be auto renewed at the end of the valid period.
• Your payment card will be charged for fees on the day of expiry.
• You will get prior notice with auto renewal details of the subscription plan before a week. However, it’s your responsibility to check and be aware of any renewal dates.
• Your current subscription plan will be auto renewed for the same duration (monthly/yearly).
• You can cancel your subscription plan before midnight of expiry day to avoid auto renewal.

Subscription Cancellation:

• Users can cancel their subscription plan at any time they want by accessing account settings.
• It may take up to 48 hours for the subscription cancellation to be effective.
• All the subscription package benefits will be active and accessible till the date of expiry, even after the cancellation of the plan.

Refund Policy:

• No refund requests will be accepted for any of the subscribed plans, no matter whether you have used any of the package benefits or not.
• In case of subscription plan cancellation, you won't get a refund for any subscription fees paid to us before the package was canceled.
• We don’t have a policy for issuing prorated refunds for any subscription packages, you will not get a refund for any unused days from the subscription plan between the dates of your package cancellation and the expiry date.
• In case of any refund decisions, it will be reviewed and done at Talentmate’s sole discretion.
• All approved refund requests will be served only through their original mode of payment.
• We will not guarantee or provide any time details regarding the refund amount reaching the Users accounts.

Other Payment Policy Terms:

• If any User account got suspended or terminated for violating these Terms of Service or for any other reason, any payments you have made to the Talentmate will be immediately forfeited.
• All subscription payment processes from the Users will be redirected to third-party gateways to complete the transactions which are not operated by Talentmate.
• Talentmate retains the right to make changes to these subscription packages, if necessary, without any prior notice. The details of such modification of subscription plans will be updated on the respective website pages.
• All the user subscription plans, benefits, fee credits and other connected things are non-transferable.

All credit or debit cards details of the users will not be stored, shared, sold, rented or leased to any third parties.

If you have any issues subscribing to a plan or while using it, it is your responsibility to let us know promptly about the same.

Site Security Rules

All Talentmate.com Users are prohibited from violating or making any such attempt to violate the security of the Website, App and Services, including, but not limited to:

• Any attempt or use of any software, automated program, or any similar processes (such as bots, crawlers, spiders, etc.) to have an unauthorized access to use the Platform or to extract any content or data from the Platform, including without limitation, creating or downloading user profiles, gathering contact details, etc.
• Getting access to or attempting to gain access without authorization (via hacking or password mining, etc.) to any part or feature of the Platform or any products or services made available on the Platform that are not meant for your use, or to any website, program, server or computer systems owned or used by the Platform or any Users or any third parties.
• Any attempt to access the Platform using APIs or thorough interfaces other than those specifically provided by the company. Users are not allowed to violate or attempt to breach any security or authentication measures put in place by the company regarding the Platform. Any attempt to scan, probe or test the system or network susceptibility is prohibited as well.
• Circumventing or trying to circumvent any technical safeguards put in place by the company or any third party to safeguard content on the Platform, or to prevent bots, crawlers, spiders, etc. from accessing and scraping content from it.
• Attempting to interfere in any way (including but not limited to, through uploading a virus to the website or spamming or overloading or mailbombing) with any user, host or network's ability to receive the services.
• Sending or trying to send any unsolicited email that includes advertisements for products and services or any promotional material in it.
• Forging, in any email or newsgroup post, the TCP/IP packet header or any portion of the header information.

These Site security rule violations could lead to legal or criminal responsibility. Talentmate will look into the incidents that might entail such violations, and it may involve law enforcement agencies or corporate with them in prosecuting those users who breached these rules.

THE COMPANY SERVICES AND ALL AVAILABLE INFORMATION ON THE PLATFORM (ABOUT COMPANY, PRODUCTS OR SERVICES) IS PROVIDED ON ‘AS IS’ AND ‘AS AVAILABLE’ BASIS WITHOUT ANY WARRANTIES OF ANY KIND. THE TALENTMATE DISCLAIMS ALL WARRANTIES (TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW) INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF NON-INFRINGEMENT OF THIRD PARTY’S RIGHTS, MERCHANTABILITY, TITLE, ACCURACY OF DATA, AND FITNESS FOR A SPECIFIC PURPOSE.

TALENTMATE DISCLAIMS ANY WARRANTY THAT THE PLATFORM WILL OPERATE ERROR-FREE OR UNINTERRUPTED OR THE WEBSITE, APP AND THEIR SERVERS ARE FREE FROM ANY COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. THE COMPANY IS NOT RESPONSIBLE FOR ANY COSTS OF SERVICING OR REPLACING EQUIPMENT OR DATA THAT OCCURRED DIRECTLY OR INDIRECTLY BECAUSE OF YOUR USE OF THE PLATFORM. Limitation of Liability

AT ANY PART OF THE DISCUSSIONS BETWEEN THE EMPLOYERS AND CANDIDATES OR ANY THIRD PARTY, TALENTMATE.COM IS NOT PART OF ANY SUCH CONVERSATIONS AND IN NO EVENT SHALL IT BE LIABLE TO THE EMPLOYERS, CANDIDATES OR ANY OTHER PARTY FOR ANY KIND OF DAMAGES RESULTING FROM SUCH INTERACTIONS OR EMPLOYMENT CONTRACT AGREEMENTS. NEVER WILL THE TALENTMATE.COM'S AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS, WHETHER IN UNDER TORT, CONTRACT OR OTHERWISE, GO BEYOND THE FEES YOU HAVE PAID TO US. Talentmate owns the Website and App, and all its intellectual property rights (registered or unregistered), including, but not limited to, database rights, patents, trademarks, brand elements, logo, copyrights, service marks, domain names, trade secrets, etc.

Any copies you are allowed to create herein, and any know-how concerning the Site and Services are owned by Talentamte and is protected by applicable laws.

Users are granted limited and terminable personal license to use Talentmate Website, App or Services given that they are in compliance with these Terms of Service. Users may not, under any circumstances, assign, sublicense/transfer the license; and any such attempt is null and void. You are only given a restricted authorization to use the Platform under the conditions clearly outlined in these Terms of Service. No other rights are provided to you with your personal use license. You are bound to respect Talentmate’s intellectual property rights and trade secrets.

We do not endorse or evaluate any third-party links or contents and is not responsible for such contents.
