Overview of the role:

To ensure the successful management & governance of Commercial & Contracts administration for designated Business Units, protecting the exposure of the Company to commercial risks on current & in the long term, together with adherence to the commercial procedures

What you will do:

Responsible for

1- Pre Bid Activities:

  • Review of tender documents in accordance with DOA & provide contractual advice and other support services as may be required from time to time.
  • Pre-contract negotiation (working alongside estimating function) and review of cost sheet of the projects

2- Review of Contract / Commercial documents

  • Review of contracts as per DOA & submit formal evaluation to management on contract conditions offering risks & opportunities
  • Coordinate with Group Legal for approval as required on external contracts

3- Project / Contract Performance Tracking & Management

  • To provide direction on contract commercial administration of contracts to ensure the financial success of construction operations and to keep the Business & Finance Head(s) and SMD informed of all material events.
  • Ensure the team delivers timely submission of all relevant data required to monitor and analyze individual contract performance on a monthly and quarterly basis.
  • To have monthly meetings on financial success of projects through monthly cost/value reconciliation and comparisons with Estimates.
  • Ensure timely and accurate finalization of forward projections / cost to complete (CTC) of the projects on quarterly base.
  • Ensure identifying and valuing the direct and indirect cost of variations & claims.
  • Responsible for the measurement & effectiveness of all processes internal & external to provide timely, accurate & complete reports on the operating condition of the business to the Stake holders.
  • Controls & Monitors an analysis of activities, costs, operations & forecast data to determine business progress & future course of action

4- Client Administration

  • To ensure that all necessary notices and submissions required by the various forms of contract are given in an expedient manner so as to protect the business’ position in its contracting activities.
  • To ensure timely submission of contract payment applications together with all details covering additional cost claims, variations, Extension of time claim, etc. Ensure timely agreement of final accounts with customers.
  • Securing timely payment certificates from customers & assisting in collection of outstanding debts
  • Tracking Bank Guarantees in coordination with Finance department, reducing the liabilities in coordination with Treasury with project progress and securing back the original guarantees from customers upon completion of projects / jobs

5-General

  • On - going advice & support to Estimating / Operations / Commercial teams.
  • Enhance operational efficiency and productivity standards. Clarifies and corrects any procedural problems. Evaluates the feasibility of new or revised systems and procedures to ensure compliance with established standards.
  • Evaluate the feasibility of new or revised business proposals, products, markets (geographies) & principal/client relationships and advises management accordingly
  • Responsible for directing all company policies related to Commercial & Procurement within the business, directing & controlling all divisional/departmental activities to achieve business goals & objectives
  • Exercises authorization as defined within the prescribed policy parameters & DOA.

Required skills to be successful:

Job-Specific Skills:

  • Professional membership of recognized institute e.g. RICS
  • Formal Qualification in Materials Management with be an added advantage
  • Comprehensive understanding of the principles of contract law [FIDIC]
  • Comprehensive knowledge and experience within the contracting industry.
  • Understanding of production/project budgets and ongoing monitoring of financial performance.
  • Knowledge of construction/project planning/costs in use.
  • To have successfully carried out all commercial management functions on a diverse range of construction projects, in capacity of Head/Senior management position in commercial.
  • Experience of managing, mentoring and developing staff

Behavioural Competencies

  • Ability to present information to a range of people.
  • Logical and creative ability in resolving problems.
  • Ability to lead a team by example.
  • Ability to draft contractual advice notes.
  • Experience of producing cost and value information.
  • Experience in dispute resolution

What equips you for the role:

Minimum Experience:

10+ years of experience in the contracting Industry of which minimum of 5+ years in Leadership/ Managerial role.

Minimum Qualifications and Knowledge:

  • Relevant degree, preferably engineering, with a management qualification from reputed institute.
  • Chartered membership of the Royal Institute of Chartered Surveyors (MRICS) or other internationally recognized institutions preferred.
  • Experience of working in the Middle East or Internationally with FIDIC and other international forms of contracts.
  • Relevant work experience including extensive contracts administration, negotiation and claims management exposure.
  • Has experience dealing with high value claims, dispute resolution, and arbitration.
