Foreclosure Defense Attorney (Contract / Hourly – 40 hrs/week)

New York-based litigation practice seeks an experienced foreclosure defense attorney for a full‑time contract role. Position involves active foreclosure litigation, court appearances, motion practice, and homeowner representation in NY Supreme Court. Emphasis on substantive advocacy, procedural rigor, and hands‑on case management rather than high‑volume work.

Key Responsibilities

• Defend residential (and some small commercial) foreclosure actions in New York Supreme Court
• Draft and file pleadings, including answers, affirmative defenses, oppositions, and motions
• Analyze foreclosure cases for:
• Standing defects
• Statute of limitations issues
• RPAPL
• 1303 /
• 1304 compliance
• Service and procedural deficiencies
• Appear at:
• Mandatory settlement conferences (CPLR
• 3408)
• Motion calendars
• Conferences and hearings
• Communicate directly with clients regarding case status, strategy, and next steps
• Coordinate with opposing counsel, court personnel, and third parties as needed
• Assist with negotiation of loan modifications, settlements, and other foreclosure alternatives when appropriate
• Maintain accurate case notes and comply with court deadlines and filing requirements
  

• Active New York State Bar admission
• 2+ years of experience in foreclosure defense, real estate litigation, or related housing litigation
• Working knowledge of:
• New York judicial foreclosure process
• RPAPL, CPLR, and NY foreclosure statutes
• Supreme Court practice (Kings, Queens, Bronx, New York, Richmond, or surrounding counties)
• Experience handling court appearances independently
• Strong legal research, writing, and issue‑spotting skills
• Ability to manage multiple active matters with minimal supervision
  

• Prior experience representing borrowers or homeowners in foreclosure actions
• Familiarity with:
• Statute of limitations litigation (six‑year rule / de‑acceleration issues)
• Post‑judgment foreclosure matters
• Motions to dismiss and summary judgment practice
• Comfort working in a solo or small‑firm environment
• Spanish or other language skills a plus (not required)
